By Judgment No. 633 of April 2, 2025, the Regional Administrative Court (TAR) of Tuscany upheld the appeal filed by the Municipality of Lucca against the Tuscan Water Authority (AIT) and Gaia S.p.A., overturning the AIT decision that had rejected the request to safeguard the independent management of the integrated water service within the municipal territory.
The Municipality was represented by Luca Spaziani and Alberto Fantini of Tonucci & Partners, who highlighted AIT’s failure to verify the existence of the regulatory requirements provided for by law.
This is a significant ruling, not only for the Municipality of Lucca but also for other local authorities, as it clarifies the limits of the Area Authority’s powers and provides guidance on the correct regulatory framework for safeguarding local management of water services.
