Following the approval of Legislative Decree n. 136 dated September 13th 2024 and published on the Official Journal on September 27th 2024, the Business Crisis and Insolvency Code has been newly changed.
In particular, a fundamental aspect concerns ongoing arrangement composition plans: introducing the new article 118-bis, specific regulations have been provided with regard to essential significant changes to the post-approval plan. The update introduced by Correctivo-ter aims at strengthening transparency and responsibility in the process of the composition with creditors, ensuring that the information necessary to take informed and aware decisions is available to all parties involved.
