Luca Calò of Tonucci & Partners, member of the “Negotiated resolution” Study Commission, contributed to the publication ” Conduct principles for negotiated resolution experts” published by the National Chartered Accountants Council and the National Accountants Establishment. The publication defines guidelines and best practices for the role of Experts in negotiated resolution of business distress.
The analysis aims at providing a methodological and operational framework to support professionals responsible of managing one of the most important institutional tools introduced by the Business Distress Code, enhancing the role of the Expert as an independent entity in charge of facilitating interaction among entrepreneurs, creditors and stakeholders, in order to promote timely and effective recovery process. The development of the principles represents an important contribution to the evolution of professional practice, offering guidance on the requirements necessary for being an expert, the conduct of negotiations, the expression of opinions, business monitoring and the responsibilities related to the assignment. The aim is to promote shared standards of competence, independence and professional quality.
