Beach Concessions: turning point of Regional Administrative Court (TAR) regarding extensions

Recent rulings regarding beach concessions continue to fuel discussions on the relationship among entrusting procedures, project financing and European competition principles. Giunio Tonucci of Tonucci & Partners analyzes, in this comment published on ItaliaOggi, the Ruling No. 562/2026 of Lazio Regional Administrative Court (TAR) – Latina Section, which upheld the appeal of the Italian Competition Authority against several resolutions of Gaeta Municipality regarding the management of state-owned maritime concessions.

The decision brings forth the principles of transparency, impartiality and maximum participation enshrined in European law, and points out that that concessions entrusting must be carried out through competitive procedures open to the market, guaranteeing effective competition among economic operators. The Regional Administrative Court emphasizes, in an important excerpt, the necessity to clearly define the selection criteria and the methods for evaluating proposals, reiterating the centrality of tender procedures in the management of maritime state concessions.

This ruling is meant to have implications beyond this specific case and offers important guidance for public administrations and economic operators facing the evolving regulatory and law case framework.
