In his article “Trademarks of national interest: business activity termination, usage application, check and supervision”, published on IPSOA Quotidiano, Vincenzo Iacovazzi of Tonucci & Partners analyzes the Decree of Enterprise and Made in Italy Ministry dated October 28th 2024 implementing art. 7 of Law 206/2023 which is meant to pursue the aim of supporting and promoting, both at a national and international level, our country’s productive excellence and cultural heritage.
Among other issues, by summarily illustrating the operating methods, the contribution points out that companies, including foreign ones, which intend to invest in Italy or transfer production activities located abroad in our territory, can apply for and request the usage of those trademarks who are registered from at least fifty years or which can demonstrate continuous activity for at least fifty years, which has been taken over by MIMIT following received notification by the owner or licensee company regarding the intention to definitively cease the activity, if the latter has not sold it for valuable consideration.
