Alberto Fantini of Tonucci & Partners attended as a teacher the “Advanced Training Course on Sports Law, Management and Communication”, set up by the Law Department of Perugia University, in collaboration with Hook 231 S.r.l. and sponsored by CONI.
By addressing the procedural profiles and aspects related to safety, technical – functional (federal and CONI regulations) with regard to the implementation of interventions on sports facilities, Alberto Fantini discussed the topic “Sports facilities: regulatory and technical aspects about their construction” and explored in depth the following issues: legislation regarding sports facilities, project financing, sports facility manager responsibility.
In particular, as per Legislative Decree no. 38/2021 – one of the implementing decrees regarding Sport Reform – special attention was paid to the regulatory framework which implies the legislation on facilities to be contained in a single format and strongly oriented towards simplifying and streamlining procedures with certain terms and clear steps. Through public-private partnerships, it should encourage investments in modern, safe systems of high functional standards and constitute the starting point for capitalizing companies and increasing revenues. Furthermore, innovative and derogatory procedures are introduced with regard to a straight and free assignment of basic sports facilities to clubs and sports associations in order to motivate aggregation, social and youth inclusion as well as procedures regarding their management by Sports Federations.
