With the chapter entitled “Assessing Recovery Plans Feasibility in the Credit Process: General Principles, Case Law and Operations”, Luca Calò of Tonucci & Partners contributed to “Recovery Plans” guidelines published by IPSOA – Wolters Kluwer and edited by Andrea Panizza and Alessandro Danovi.
The author analyzes the principal role this assessment plays in the relationship between distressed companies and the banking system, examining the criteria on which basis the financial institutions assess the reliability and sustainability of the plans submitted. Particular attention is paid to the general principles, the most relevant case law and the operational implications that guide credit providers’ decisions in a constantly evolving regulatory environment.
