The round table “Criminal Law Reforms” which took place on February 26th 2025 and was set up by Tonucci & Partners in collaboration with Consenso, brought together distinguished University, Attorneys’ Bars and media top-level speakers who discussed issues concerning criminal justice reforms
Andrea Delmastro Delle Vedove, Ministry of Justice Undersecretary, pointed out that there is no punitive intent towards the Judiciary, but the purpose to restore its social upright. Furthermore, he recalled the importance of the drawing lots to reduce internal currents consequences and reiterated that split of careers is necessary to guarantee judges’ neutrality, without however subordinating the public prosecutor to the executive.
Giuseppe Chinè, State Councilor and F.I.G.C. Federal Prosecutor, spoke about the draw, proposing as an alternative a system based on seniority and eligibility, as it works in administrative justice, to avoid errors and appeals caused by CSM criteria.
The event coordinator, Giorgio Altieri of Tonucci & Partners, expressed his support to the reform, pointing out that judiciary autonomy and independence are guaranteed by Article 104 of the Constitution, even according to the new version currently being approved. He also called for action on the statute of limitations and prison overcrowding which was an issue taken up also by Giuseppe Belcastro, President of Rome Criminal Law Chamber, who defined as unacceptable the situation at Rebibbia jail, suggesting as only possible immediate solution a pardon for prisoners who are not socially dangerous.
Adolfo Scalfati, Professor at Rome Tor Vergata University, recalled at the end that judiciary constitutional reform is, in any case, a legislative reform and judges should apply the law without interfering with its content. The drawing of lots is the only tool currently available to guarantee a fairer Superior Council of the Judiciary.
