Healthcare payback: the Council explains why it is legitimate

As per its ruling of last July, the Constitutional Court deemed legitimate healthcare payback, a mechanism which provides the return of a portion of their turnover by companies supplying medical devices if the overall Region expenditure exceeds the established limits.

However, introduced in order to safeguard public finances and remedy poor planning and expenses management, this system becomes a burden for companies, especially biomedical ones.

What are the main reasons for which the Council issued this ruling? Which are its legal basis and how does it reconcile with the biomedical sector companies rights?

Piergiuseppe Venturella of Tonucci & Partners was interviewed by Panorama to comment the legal implications of this system. “The consequences of this mechanism – stated Mr. Venturella – will be serious: the lack of materials will lead to the necessity of other thousands of procurement regarding essential supplies of devices such as coronary stents, heart valves and prostheses, given that many companies might close”.
