Assisted by Luca Spaziani and Alberto Fantini of Tonucci & Partners, Lucca Municipality challenged before TAR the decision issued on September by Tuscan Water Authority (AIT) which had denied to Geal the possibility of safeguarding the management of the water service.

The appeal starts from the denial opposed by AIT to the request concerning the independent management pursuant to art. 147, paragraph 2-bis of TU Environment presented by the Municipality.

The lawyers point out that the failure to recognize to Lucca Municipality an independent management safeguarding, followed by the consequent takeover of Gaia management, is designed to lead to service management at a level not corresponding to the current one, possibly causing in this way disservices to customers.
