The 6th edition of the Higher Training School for Local Public Services Management, promoted by Labelab srl as part of the event “Dealing with the environment”, took place on May 23rd and 24th 2024.
Alberto Fantini of Tonucci & Partners attended the event as teacher of the specialized section “The liberalization of concessions market (beach resorts, lakes and rivers) and the competition draft law – guidelines regarding selective procedures for new assignments”. Addressing, among others, the current issue related to the authorization lapse that can no longer be extended also in light of recent judgements, Alberto Fantin focused the attention on the critical aspects that the competent bodies will have to consider while setting up new tenders.
In Italy, this issue is a complex and highly topical argument related to the management of beaches and their respective commercial activities. The expiry of the authorizations is a crucial element which has brought forth a lively political and legal debate especially in relation to the European Bolkestein directive and the rulings of the Italian judicial bodies. The solution to this knotty problem requires a balance between compliance with European regulations, acquired rights protection and promotion of natural resources sustainable usage.
