Decisions No. 10434/2025 and No. 57/2026 of Council of State Fifth Section definitively confirmed the assignment legitimacy of Lot 1 of the three-year tender issued by Guardia di Finanza Naval Center regarding the supply of fuel to the Corps’ naval vessels, fully rejecting second and third-place tenderers appeals.

The decisions acquire particular interpretative meaning in the application of the new Public Contracts Code by affirming, among other principles, the legitimacy of grouping’s cumulative asset of requirements, the regularity of the preliminary investigation in case of formal ambiguities and the overall valorization of contracting authorities’ autonomy.
