Back to the future: the legal return of the gaming sector after the summer break is expected to be full of changes

It is well known that the gaming sector is undergoing a deep transformation following the implementation of Legislative Decree No. 41 dated March 25th  2024 with regard to gaming reorganization. The process of assigning new remote gaming licenses which started with the publication of the relevant tender on December 17th 2024, is still ongoing. This fall, key steps are expected to lead to the actuation of the new licenses by the first quarter or, at least, the first half of 2026. The land-based gaming market will also go through significant changes in the upcoming months in order to comply with the provisions of Decree No. 41/2024.

Other developments are related to the reform concerning the regulations governing gaming sector sponsorship and advertising—with particular focus on the advertising ban—and also the take effect of several general European regulations such as Data Act and AI Act that will directly impact gaming operators.
