The Lazio Regional Administrative Court (TAR), Latina Division, rejected the appeals filed by the second- and third-ranked tenderers against the award of Lot 1 of the tender issued by Guardia di Finanza Naval Center. The tender concerned the three-year supply of fuel for the Corps’ naval vessels and was awarded to the Temporary Grouping of Companies (RTI) composed by Rossetti S.p.A. as lead company, and Saccne Petroli S.p.A. and Nobile Oil Group S.p.A. as members. RTI was assisted by Tonucci & Partners team, comprising Luca Spaziani and Giorgio Altieri, with the support of trainee Vincenzo Ficco.
In relation to the temporary grouping horizontal type (“RTI orizzontale”), the Court clarified, inter alia, that the failure to expressly indicate the respective execution quotas does not automatically entail exclusion from the tender procedure, provided that such quotas can be inferred from the submitted documentation.
