The Regional Administrative Court of Lazio has deemed to submit before the Constitutional Court the question of constitutionality raised by Tonucci & Partners concerning Article 57 quater of Decree Law No. 50/2017, converted into Law No. 96/2017, providing a readmission clause only for wind farms related to the “EOLN-RG2012” register which have been excluded from FiT regime for providing an incorrect date of authorization of the plant during the registration process. The Constitutional Court will be asked to rule on the violation of principles of equality, reasonableness, impartiality and good performance of the public administration activity.
